About these terms of use

These terms of use apply to topcash4cars.ca and to every quote, pickup and vehicle purchase by Top Cash 4 Cars (“we”, “us” or “our”). By using this website, requesting a quote or selling us a vehicle, you agree to these terms. If you don't agree, please don't use the website or our services.
Using this website
The information on this website is general information about our services. It isn't legal, financial or tax advice. Payout figures on the site, such as offers of up to $10,000 or minimums starting at $300, are general ranges, not an offer for your vehicle. Only a quote we give you directly is an offer.
When you use the site, you agree not to:
- Send false information, or information about a vehicle you aren't entitled to sell
- Interfere with the site, try to access it without permission or use automated tools to copy its content
- Use the site for anything unlawful
The text, design, logos and images on this site belong to Top Cash 4 Cars or are used with permission. You may not copy them for commercial use without our written consent.
How our quotes work
Every quote is based on the information you give us about the vehicle: its year, make, model, mileage, condition, completeness and location. A quote is firm as long as the vehicle matches that description.
If the vehicle doesn't match when we arrive, we may revise or withdraw the offer before any payment is made. Common reasons include undisclosed damage, missing parts such as the catalytic converter, battery, wheels or engine components, a different mileage, or a car that doesn't run when we were told it does. You're free to decline a revised offer, and you won't be charged for the visit.
The sale is complete only when you accept the offer at pickup, sign the bill of sale and receive payment.
Offer validity and scrap prices
Scrap metal prices and used-car demand change, sometimes quickly. Because of that, every quote is valid for a limited time only. We'll tell you how long your offer is held when we give it to you. After that, we may update the offer to reflect current prices.
Ownership and authority to sell
You may only sell us a vehicle if you're its registered owner or are legally authorized to sell it, for example with the owner's written authorization, as the executor of an estate or as someone with signing authority for a business. At pickup, you must show valid government photo ID and the vehicle's ownership (vehicle permit), or other documents we've agreed to in advance.
Any loan or lien on the vehicle must be paid off or disclosed to us before the sale. You confirm that the information you give us is true and that, to your knowledge, the vehicle isn't stolen. We may decline any sale if we can't verify identity, ownership or authority, and we may report suspected stolen vehicles or fraud to police.
Pickup, payment and transfer
Towing is free for vehicles we buy. You agree to give our driver safe, legal access to the vehicle, and to tell us in advance about anything that affects the pickup, such as underground parking, gates or a vehicle that won't roll. We may reschedule a pickup for weather, safety or access reasons.
Payment is made in cash on the spot at pickup, once the vehicle has been checked and the paperwork is signed. Ownership of the vehicle passes to us when the bill of sale is signed and payment is made.
Remove your personal belongings, licence plates and any toll transponder before pickup. In Ontario, licence plates belong to you, not the vehicle. We aren't responsible for items left in the vehicle after the sale.
Best offer guarantee
Best Offer Guaranteed: we’ll beat any written offer. To qualify, the other offer must be in writing, genuine and still valid. It must be made by another buyer for the same vehicle in the same condition, and shown to us before you accept our offer. We may confirm the offer with the buyer who made it, and we may decline offers we can't verify.
Limitation of liability
This website and its content are provided “as is”. We work to keep the information accurate and current, but we don't promise that it's complete, error-free or always available.
To the fullest extent permitted by law, Top Cash 4 Cars isn't liable for any indirect, incidental or consequential loss arising from your use of this website or our services. For any vehicle purchase, our total liability is limited to the purchase price agreed for that vehicle. Nothing in these terms limits any rights you have that can't be limited or waived under Ontario law.
Privacy and governing law
How we handle your personal information is explained in our privacy policy.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario.
Changes to these terms and contact
We may update these terms of use from time to time. The date at the top of this page shows when they were last changed, and the version posted when you request a quote is the one that applies to it.
